Deerfield Township Standard Programming Waiver
FOR MINOR PARTICIPANTS: I, the undersigned, certify that I am the legal parent/guardian of the individual(s) participating in the Deerfield Township Parks and Recreation event/class/team (the “Program”). I understand that all acknowledgements and agreements contained in this Standard Programming Waiver, to which I am demonstrating my understanding and agreement by signing below, are made on behalf of both myself and the participant(s).
ASSUMPTION OF RISK: I acknowledge that participating in the Program poses inherent risks, dangers and hazards, which may arise from foreseeable or unforeseeable causes, and that such risks, dangers and hazards cannot be fully eliminated. I willingly, freely and voluntarily agree to assume all risks, dangers and hazards, and all responsibility for any losses and damages arising out of, or in any way related to, my participation in the Program.
WAIVER AND RELEASE: In consideration for allowing me to participate in the Program, I hereby, for myself, and my executors, administrators and assignees, hold Deerfield Township and all of its officers, representatives and employees; all sponsors, affiliates and parties allowing use of real and/or personal property for the Program; coordinating groups; volunteers; and any other individuals associated with the Program in any way (collectively, the “Released Parties”) harmless from any and all liability, causes of action, debts, claims, damages, demands and expenses (including reasonable attorneys’ fees) of any nature whatsoever in connection with loss of life, personal injury, illness and/or damage to real and/or personal property arising out of, or in any way related to, my participation in the Program.
PHOTOGRAPHIC RELEASE: I hereby grant and convey to the Released Parties all right, title and interest in any and all photographs, images, videos and audio recordings of me, my likeness and/or my voice, with or without my name attached to the same, taken in connection with my participation in the Program.
EMERGENCY MEDICAL AUTHORIZATION: In the event of a medical emergency, I hereby give my consent for 1) transfer to the nearest hospital reasonably accessible; and 2) the administration of any treatment deemed necessary by a licensed physician or dentist. This authorization does not cover major surgery, unless the medical opinions of two (2) licensed physicians or dentists, concurring in the necessity for such surgery, are obtained prior to the performance of such surgery.
REFUND POLICY: I understand that any changes to my enrollment in the Program must be requested no later than ten (10) business days prior to the first Program session (in the case of Community Garden programming, the “first Program session” shall refer to the first day on which my garden plot is made available for me to garden). Refunds will only be granted when requested no later than ten (10) business days prior to the first Program session. All refunds are subject to a $10.00 processing fee for each canceled registration. Since decisions to maintain classes are based on total participant enrollment as of the first Program session, no refunds are granted after the first Program session. In case of class cancellation by Deerfield Township, you will be granted a full check refund (without the $10.00 processing fee charge). Please allow ten (10) business days for processing of all refunds.
All programs will follow the Kings Local School District for inclement weather closings. Make-ups for weather related cancellations are decided on a class by class basis. Program times and locations are subject to change.
OHIO REVISED CODE 5101:2-18-03 REQUIREMENTS FOR REGISTERED DAY CAMPS: The following telephone numbers are being provided for parents/guardians of children participating in day camp and may be used for making a complaint: Warren County Department of Health 513-695-1228 and Warren County Children Services 513-695-1546.
By executing this Standard Programming Waiver, I hereby demonstrate my understanding of the terms and agreements contained herein, and my agreement to be bound by the same.
